These Terms of Service govern your use of vp.photos and any client gallery, store, or page hosted on it. The site is operated by Vincent Parker, based in Colorado Springs, Colorado. By visiting or using the site, you agree to these terms. If you do not agree, please do not use the site.
Purchases made through the store are additionally governed by the Terms of Sale. Digital session files are additionally governed by the Digital Image License. Where those documents address a subject specifically, they control over these general terms.
1. Who may use the site
The site is intended for use by adults. If you are under 18, use it only with the involvement of a parent or guardian. Do not submit personal information through the site without their permission.
2. Ownership of site content
All content on this site, including photographs, text, layout, design, and graphics, is my work or is used with permission, and is protected by copyright. All rights are reserved in perpetuity.
Nothing on this site is public domain, royalty free, or free to use because it is visible in a browser. The absence of a watermark does not mean an image is free to take.
3. Permitted use of the site
You may browse the site, view images, and share links to pages for personal, non-commercial purposes.
You may not:
• download, copy, screenshot, screen record, or save images for reuse, except where a download is expressly offered to you
• reproduce, republish, distribute, sell, or display any image or content, in print or online, without my prior written permission
• use any content in advertising, promotion, or any commercial context
• crop, filter, retouch, or otherwise alter any image, or remove or obscure any credit, watermark, or embedded metadata
• use any content to train machine learning or generative AI systems, or to build any dataset for that purpose
• scrape, crawl, harvest, or bulk download content from the site by any automated means
• frame, mirror, or embed the site or its content in a way that suggests affiliation or endorsement
• attempt to gain unauthorized access to any private gallery, account, or part of the site, or interfere with its operation
Requests to use an image are usually granted for reasonable non-commercial purposes. Email vincent@vp.photos and ask.
4. Client galleries
Private galleries are delivered to the client who booked the session. If you have been given access to a gallery:
• The gallery link and any password are for you and the people you choose to share them with. You are responsible for what happens with them once shared.
• Access to a gallery is not a license to use the images. Use of any files you download is governed by the Digital Image License.
• Galleries remain available for the period stated when the gallery is delivered. Download and back up anything you want to keep before then.
• I may remove or restrict access to a gallery if it is being used in a way that breaches these terms.
5. Messages you send through the site
If you submit an inquiry, booking request, or other message through the site, you confirm the information you provide is accurate and that you have permission to share any details about other people that you include.
An inquiry or a submitted form is not a booking. A session is confirmed only when we have agreed on it directly and any required deposit and agreement are in place.
6. Privacy
Information you submit through the site is used to respond to you and to fulfill orders. It is not sold. Details are described in the Privacy Policy.
7. Third-party services and links
The site relies on third-party services for hosting, payment processing, and order fulfillment, and may link to other sites. I am not responsible for the content, practices, or availability of any third-party site or service. Their terms and privacy policies govern your use of them.
8. Availability
I make no guarantee that the site will be available without interruption or free of errors. Pages, galleries, prices, and product offerings may change or be removed at any time without notice.
9. Disclaimer and limitation of liability
The site and its content are provided as is, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, I am not liable for any indirect, incidental, or consequential damages arising from your use of the site. My total liability arising from your use of the site is limited to the greater of the amount you paid me in the preceding twelve months or one hundred dollars.
Nothing in these terms limits any right you have under applicable consumer protection law that cannot be waived.
10. Indemnity
You agree to cover any claim, loss, or expense, including reasonable legal fees, arising from your misuse of the site or its content or your breach of these terms.
11. Enforcement
I may restrict or block access to the site for anyone who breaches these terms. Unauthorized use of my images is copyright infringement, and I reserve all rights and remedies available under copyright law.
12. Changes to these terms
I may update these Terms of Service at any time. The version posted here is the version in effect. Continuing to use the site after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Colorado, United States, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in El Paso County, Colorado.
